| Why did the police charge Occupy Central participant Ken Tsang Kin-chiu on the same day it charged seven policemen for allegedly beating him up？ Many people believe it was a political decision by the police to remind the public that Tsang Kin-chiu had also allegedly broken the law by attacking the police and resisting arrest before seven policemen allegedly beat him up. You may be wondering why I have used the word “allege” so many times. The word “allege” means to claim something has happened. Tsang Kin-chiu alleges or claims that seven policemen beat him up on October 15 last year during a violent Occupy Central protest. The police allege that he had attacked the police. Under Hong Kong’s legal system, the word “allege” must be used because the allegations have not yet been proven in court. If the judge finds the seven policemen or Tsang Kin-chiu guilty, then it is no longer necessary to use the word “allege”. Under Hong Kong’s legal system, once a case goes to court, the media is not allowed to comment on it except for what is said in court because the case is sub judice. It is a Latin word that means a case that is already being considered by a judge. Since the cases of Tsang Kin-chiu and the seven policemen are both sub judice, I won’t comment on which side is right or wrong. But both cases remind me of the well-known saying “a picture is worth a thousand words”. This expression means a picture can help you to understand a complicated issue much better than words. The alleged beating of Tsang Kin-chiu in a dark area in Admiralty was filmed by TVB. Most Hong Kong people were shocked when they saw the alleged police beating. The TV video was worth a thousand words and the public demanded that the seven policemen be charged. But television video also showed Tsang Kin-chiu allegedly pouring liquid on policemen before the beating. That video was also worth a thousand words. So it is unfair for his supporters to say he was charged for political reasons. * * * 警方在落案起訴七警涉嫌（allegedly）毆打佔中參與者曾健超，為甚麽同日起訴曾健超？許多人相信這是警方的政治決定，以提醒公眾曾健超亦有涉嫌（allegedly）違法，於七警涉嫌（allegedly）毆打他之前，襲擊警察及拒捕。你可能會疑惑，為何我多次使用allege這個字。Allege意指宣稱某事的發生。曾健超聲稱（alleges）七警於上年十月十五日、一場激烈的佔中示威期間毆打他，警方則宣稱（allege）他襲擊過警察。 根據香港司法制度，allege這個字必須要使用，因為指控（allegations）並未經過法庭的核實。若法官判定七警或曾健超有罪，那就不再需要用allege一字。在香港司法制度下，一旦案件上了庭，傳媒除了法庭上所說的，一律不得再評論案件，因為案件是sub judice。Sub judice是個拉丁字詞，指案件已在審理中。由於曾健超和七警的案件也被審理中（sub judice），我不能評論誰對誰錯。但兩宗案件也讓我想起了一句人所共知的說話：“a picture is worth a thousand words”。 這個習語的意思是「一圖勝千語」，影像比言語更能助你了解複雜的議題。曾健超據稱（alleged）在金鐘的幽暗角落被打，過程被無綫拍攝記錄了。大部份香港人見到警方涉嫌（alleged）毆打時，都非常震驚。電視片段勝過千言萬語（worth a thousand words），公眾遂要求起訴七警。但電視錄影機也拍得曾健超在毆打事件發生前，涉嫌（allegedly）向警察淋潑液體，那片段亦勝千言萬語（worth a thousand words）。因此他的支持者說他是基於政治原因而被落案起訴，這樣說並不公道。mickchug@gmail.com 中譯:七刻 Michael Chugani 褚簡寧 |
